Welcome to Habari, a Nairobi-based Software-as-a-Service (SaaS) platform providing digital business cards and corporate identity solutions. These Terms of Service (“Terms”) govern your access to and use of Habari’s website, applications, and services (collectively, the “Services”). By accessing or using Habari, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Services.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use Habari. If you are using Habari on behalf of an organization, you confirm that you have authority to bind that organization.
3. Services Overview
Habari provides: – Digital business cards – Team and enterprise card management – Lead capture and analytics – QR and NFC-based sharing – Corporate branding and identity tools
Habari may update, modify, or discontinue features at any time.
4. Account Registration
To use certain features, you must create an account. You agree to: – Provide accurate and complete information – Keep your login credentials secure – Notify us immediately of any unauthorized use
You are responsible for all activity under your account.
5. Acceptable Use
You agree not to: – Use Habari for unlawful, fraudulent, or harmful activities – Upload false, misleading, or infringing content – Attempt to gain unauthorized access to systems or data – Resell or misuse the Services without written permission
Habari reserves the right to suspend or terminate accounts that violate these rules.
6. Fees and Payments
Habari services are offered on a paid subscription basis. Pricing, billing cycles, and payment terms will be clearly communicated at purchase.
All fees are non-refundable unless stated otherwise in writing.
7. Intellectual Property
All content, software, trademarks, and branding associated with Habari are the exclusive property of Habari or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services.
8. Data Protection & Privacy
Habari complies with the Kenya Data Protection Act, 2019. Our collection and use of personal data are governed by our Privacy Policy below.
9. Termination
We may suspend or terminate your access to Habari if you breach these Terms or misuse the Services. You may stop using Habari at any time.
10. Limitation of Liability
To the maximum extent permitted by law, Habari shall not be liable for indirect, incidental, or consequential damages, including loss of business, data, or profits.
11. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in Kenyan courts.
